Intervention and payment terms

This page sets out the general framework applicable to requests, quotes, deposits, payments and the opening of an intervention at NEXURA Analytics.

1. Operator identity

NEXURA Analytics operates its services in Quebec, Canada, under the public name NEXURA Analytics. Public coordinates are limited to the business channels published on the website.

2. Scope

These terms govern service requests, quotes, work authorizations, deposits, payments, cancellations, case-related communications and certain conditions for the return, shipping or delivery of media.

They constitute a general framework. Any quote, written authorization, specific agreement or document provided in the context of a case may supplement or specify them.

3. Initial request and case opening

A request submitted through the site, by email or through any other channel does not automatically create an obligation to intervene. It allows an initial case to be opened, the need to be assessed and, where appropriate, a quote or intervention framework to be prepared.

NEXURA Analytics may request additional information before confirming that a case will be taken on.

4. Quote and pre-approval

Any intervention, deposit, cancellation and specific refund condition must be outlined in a quote sent to the client and pre-approved before work begins.

The quote may specify:

  • the nature of the intervention;
  • the device or media involved;
  • the known scope of the engagement;
  • limitations identified at that stage;
  • fees, deposits or payment terms;
  • estimated timelines;
  • specific conditions applicable to the case.

No work should begin before the applicable pre-approval is received, unless a specific written agreement provides otherwise.

5. Pricing, deposits and payments

Publicly displayed pricing is indicative where presented as such. The final price applicable to a case, including taxes, logistics fees or specific conditions, must be confirmed in writing before any final authorization or payment.

When a deposit is requested, its purpose includes reserving case handling, committing necessary resources and covering the initial stages of preparation, assessment, processing or logistics.

A payment may be requested as a deposit, partial payment, final payment or one-time payment, depending on the nature of the case.

6. Refunds, cancellations and credits

Assessments, preliminary analyses, capacity reservations, work already begun and costs incurred may not be refundable, depending on case progress and costs already incurred.

Unless otherwise stated in writing in the approved quote, amounts paid after pre-approval may become non-refundable once preparatory, technical, logistical or administrative work has begun.

If a client cancels before work begins and before any external or logistical costs are incurred, NEXURA Analytics may refund all or part of the amounts received, subject to administrative fees or costs already incurred, if the applicable quote allows it.

Any specific refund, cancellation or credit condition must be confirmed in writing in the quote, authorization or applicable conditions for the case.

7. Shipping, transport and media return

When a device, an appliance or media must be shipped, the packaging, transport, courier, delivery and return arrangements must be agreed upon at the time of the quote or authorization.

The client is responsible for properly packaging the media before shipping it to NEXURA Analytics, unless specific handling instructions are provided. The risk associated with transport by a third party remains subject to the carrier's conditions, unless otherwise agreed in writing.

Courier, return, express delivery, local pickup or special handling fees may be charged separately where applicable. These fees must be communicated before final confirmation when reasonably foreseeable.

When the delivery or return of media requires special precautions due to case sensitivity, specific instructions may be imposed and form an integral part of the intervention framework.

8. Timelines and limitations

Timelines communicated before or during a case are provided as estimates, unless otherwise confirmed in writing. They may vary depending on the actual condition of the media, case complexity, information availability, logistical constraints or any other reasonably relevant circumstance.

Unless expressly confirmed in writing, no statement on the site or in an initial communication constitutes a guarantee of recovery, success, result, fixed timeline or particular outcome.

9. Online payment and confirmation

When an online payment is offered, it must correspond to a quote, authorization or intervention framework already communicated to the client. The requested payment must clearly reflect the nature of the amount, including whether it is a deposit, partial payment or final payment.

The client must receive a written confirmation or durable summary indicating at minimum:

  • the case identification;
  • the nature of the payment;
  • the amount requested;
  • any applicable specific conditions;
  • relevant contact details.

10. Case-related communications

NEXURA Analytics may send communications related to case opening, assessment, quoting, authorization, payment, follow-up, media return or any next step relevant to case handling.

These communications are operational in nature. They do not, on their own, constitute promotional communications.
